Port Elevator hired Casados as a temporary worker through a staffing agency.? Both Port Elevator and the staffing agency carried workers? compensation insurance.? When Casados suffered a fatal injury at Port Elevator?s facility, the carrier for the staffing agency extended coverage for benefits under its policy; however, the workers? compensation carrier for Port Elevator (Texas Mutual) denied coverage on the basis that Casados was an employee of the staffing agency and not an employee of Port Elevator.
Casados? parents sued Port Elevator for negligence, and the jury awarded damages of approximately $3,000,000.? Port Elevator appealed, arguing that it was an employer, despite the fact that its worker?s compensation carrier concluded otherwise.? Port Elevator asserted that the Casados family should have been entitled to benefits under its Texas Mutual workers? compensation policy as their exclusive remedy.
The Texas Supreme Court agreed with Port Elevator and reversed and rendered judgment in its favor. Reaffirming its decision in Wingfoot Enters v. Alvarado, 111 S.W.3d 134, 143 (Texas 2003),? the Court held that a temporary worker may be the employee of both a staffing agency and the client company, under which he is entitled to benefits under both workers? compensation policies.
The fact that Texas Mutual denied coverage didn?t mean that Casados wasn?t entitled to coverage under the Texas Mutual policy; instead, the Casados family should have pursued workers? compensation coverage under the Texas Mutual policy as its exclusive remedy.
Mary Barrow Nichols, general counsel and senior vice president for Texas Mutual, responded to the decision in a press release published by the Wall Street Journal?s MarketWatch: ?This decision is great for Texas workers because it assures them that they will be covered, and it reinforces a longstanding workers? compensation rule.???That?s a bit of a reversal for Texas Mutual, considering that the Casados family wasn?t assured of coverage the first time Texas Mutual reviewed their workers? compensation claim.

New Energy-Dense Battery Could Enable Long-Distance Electric Cars

NATIONAL HARBOR, Md.?A company founded in the Palo Alto public library has taken a dose of government money and technology and turned it into the most energy-dense battery ever. Envia System's new lithium-ion battery packs roughly twice as much energy per gram as present batteries, the company will announce here at the third annual summit of the Advanced Research Projects Agency?Energy (ARPA?e).
"We achieved 400 watt-hours per kilogram," explains materials scientist Sujeet Kumar, Envia co-founder and chief technology officer. "We have made a 40 ampere cell in a large format that automakers can recognize and use," and one that has been validated by independent energy density tests at the Naval Surface Warfare Center in Crane, Ind.
With a $4 million grant from ARPA?e, the Envia technology builds on work done at Argonne National Laboratory that found that including manganese in a mix of materials for the cathode?the electrode to which the lithium ions flock?better energy densities could be achieved. The team then switched focus to the anode?the electrode from which lithium ions flow to produce the electric current?and boosted its performance by incorporating silicon along with the typical graphite.
By blending silicon with carbon, the researchers claim to have gotten around the problems of silicon anodes that have disabled other batteries ability to charge and discharge time and time again. Simply put, silicon swells. "It will hardly last 10 cycles because of the high volumetric changes," admits Kumar. But by encasing it in a carbon coating?as well as interlacing carbon fibers?the Envia team argues it has surmounted that problem and its battery has cycled 400 times?and counting. "Even if the silicon pulverizes in the first cycle, connectivity is maintained through the carbon fibers," Kumar adds, though that impacts the voltage.
Then there is so-called "thermal runaway," an engineering euphemism for batteries bursting into flame?a persistent problem with energy-dense storage devices based on lithium-ion technology. This is particularly true in cars where batteries must undergo a test in which an 8-millimeter nail penetrates the battery at speed. Envia claims its batteries pass that test. "It's mainly that the cells are much thinner," Kumar says. "It's very easy to remove the heat," though it will be up to each individual automaker whether they want to employ air or liquid cooling of battery packs.
The slim, energy-dense batteries developed at an Envia center in China could reduce the number needed per car by half. And the batteries are cheap at $125 per kilowatt-hour, less than half what current batteries cost, an expense that contributes some 65 percent of the cost of an electric car. But, in addition to further independent testing, the Envia battery must now embark on the multi-year process of testing by actual car-makers. GM is an investor, but Envia declines to identify who is interested. "We are working with all the brand name [carmakers] around the world," says Atul Kapadia, Envia chairman and CEO. The idea is to either form joint ventures to produce the batteries in tandem or to license the technology to pre-existing partners.
But, assuming a single nail doesn't bring down the new technology, the battery could boost the range of electric vehicles, such as GM's Chevy Volt. The more watt-hours per kilogram, the farther an electric car can travel. That means a Nissan LEAF boasting Envia's batteries might be able to travel the 300 miles between St. Louis and Chicago on a single $10 charge, rather than the roughly 80 it can travel today. "We expect Envia's next generation lithium-ion battery will revolutionize the [electric vehicle] industry by eliminating the three remaining barriers to mass adoption: cost, range and safety," Kumar said in a statement announcing the breakthrough. "The ability to drive up to 300 miles on a single charge will eliminate 'range anxiety.'"

Oscar win took 'Artist' actor 'out of my body'

The bad news about winning five Oscars (including Best Picture) is that you just don't get to sleep that night -- the good news is you just don't want to, as the folks behind "The Artist" proved first thing Monday morning on TODAY. Ten members of the international cast and crew of the film all showed up smiling (and still clutching their Academy Awards) for a chat with TODAY's Ann Curry (despite the very early hour in California) and had nothing but happy thoughts to share.
"I was over the moon," said Best Actor recipient Jean Dujardin about his win. "I was ... out of my body. It's a new experience."
Producer Thomas Langmann also said their Best Picture win was "amazing." "Sometimes he (director Michel Hazanavicius) calls me the most stupid producer in the world, but now with this (Oscar) in my hand, I don't feel stupid at all."
Executive producer Harvey Weinstein, whose Weinstein Co. distributes the film, called "The Artist" "the million-to-one movie." He then added that they would be expanding the film's distribution to 2,000 theaters as of Friday.
"It says to every young filmmaker to do what you dream," he said.
And if Weinstein looked even more pleased than the actors, director and producer around him, he had particular reason: His company's film "The King's Speech" also took home the Best Picture Oscar last year, and also distributed "The Iron Lady," which earned Meryl Streep her third Oscar Sunday night.
"I like to choose interesting subjects," he said dryly. "A stuttering king and a black-and-white silent movie. I should have my head analyzed."

Family refers to the social and emotional bond that connects individuals, whether related in blood or not, and they share the same love, care, and affection with each other. Although at this point home and family both refers to the emotional, psychological, and social bonds that connects the individuals forming home and family, these concepts are distinguished in this wise; the family always refer to the subjects of the house or the persons that dwell in it while the home generally refers to the structure or residence or it may also connote the emotional and psychological experience of a person to feel the belongingness, togetherness, commonality, love, and affection while being with such people or inside such house.
The divide between this actual or tangible side of home and family from the idea or conceptual realm of the said concepts is manifest among many families nowadays. Most members of the modern families experience the extreme absence of filial or parental care and affection. This is due to the complicated lifestyle that values more on the material aspects and performs most of human activities in a mechanical way.
To illustrate, parents who are into business traveling seem not to worry about being miles away from their children since there is the advancement of communication technology that offers virtual and real time presence such as video chatting on the web and even on mobile phones. However, this development does not suffice the need for the real and actual presence of parents to express their care and affection to their growing children.
Thus, despite all of these technologies, most children do not feel at home while they are in their mansions and they do not feel the presence of their family even when their parents are with them physically. The home and family are concepts that have various ways and means for actualization. They cannot be left to mere physicality or to some abstract ideas, lest, these concepts are nothing but mere thoughts with the least value and significance for the human species.

"Fifty years ago today, Friendship 7 was orbiting planet Earth, and that helped in a very big way, paved the way for America to become a space power, and to go to the moon, and to do the things that we're doing right now on the International Space Station," Burbank said. "And we hope this also can help set the stage for us down the road to do even greater things."
Glenn had a light-hearted but educational exchange with the space station crew, asking them about the types and number of experiments on board ? more than a hundred, they said ? and explaining to his gravity-bound audience of more than 200 people that, for example, a candle burns differently in space than on Earth.
When Bolden asked the astronauts which experiment they'd like to hand off to Glenn if he could join them, Burbank suggested research on the "regenerative environmental control systems" on spacecraft.
"That's a fancy word for our toilet," flight engineer Don Pettit added. "So he wants to put Sen. Glenn busy fixing the plumbing up here."
Glenn took the humor in stride, replying: "That's exactly what I thought I was going to get assigned to."
Glenn also inquired about how far the space station had traveled during the course of the roughly 15 minutes they'd been talking. They hadn't kept an eye on the exact distance but said they guessed it was about one-fourth of the way around the Earth.
Bolden joked that Glenn sometimes bugs him about making a trip to the space station. Glenn became the oldest person to fly in space in 1998, at age 77.
